Terms of Service, Waiver, Indemnification and Hold Harmless Agreement

IMPORTANT — READ CAREFULLY. By accessing, browsing, registering for, or using EmergencyHousing.ca, Ontario CourtBuddy, or any related website, web application, tool, calculator, document, or service (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to every term below, you must not use the Services.
1 · Research and informational purposes only — not legal advice
- 1.1 The Services are provided strictly for research, educational, and informational purposes only.
- 1.2 Nothing on this site constitutes legal advice. No solicitor–client, lawyer–client, or other professional relationship is created by your use of the Services, by any calculation, estimate, form, document, clause, or report generated, or by any communication with the operator.
- 1.3 Family law is complex and fact-specific. Calculations, estimates, and generated documents are approximations for research purposes and must not be relied upon in any legal proceeding, negotiation, mediation, or filing without independent review by a licensed Ontario lawyer.
- 1.4 You are solely responsible for verifying all outputs and for obtaining independent legal advice before acting.
2 · Limited license to use
- 2.1 Subject to this Agreement, you are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial research purposes in accordance with all applicable laws.
- 2.2 You shall not: (a) misrepresent the Services' outputs as legal advice or as prepared by a lawyer; (b) attempt to circumvent security, access controls, or rate limits; (c) use the Services for any unlawful purpose; (d) scrape, copy, or redistribute substantial portions of the Services' content except for your own personal research records.
- 2.3 All intellectual property in the Services remains the exclusive property of the operator.
3 · No warranties — "as is"
- 3.1 THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF ACCURACY, COMPLETENESS, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
- 3.2 The operator does not warrant that calculations, tax tables, guideline figures, forms, clauses, or any other content are current, correct, or complete, or that the Services will be uninterrupted or error-free.
4 · Waiver and release
4.1 TO THE FULLEST EXTENT PERMITTED BY LAW, YOU WAIVE, RELEASE, AND FOREVER DISCHARGE EmergencyHousing.ca, its owner, operator, administrators, contributors, agents, and affiliates (collectively, the "Released Parties") from any and all claims, demands, actions, causes of action, damages, costs, and expenses of any kind arising out of or related to your use of, or reliance upon, the Services — including claims arising from alleged negligence of the Released Parties.
5 · Indemnification and hold harmless
- 5.1 You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your reliance on any content, calculation, or document generated by the Services; (c) your violation of this Agreement; or (d) your violation of any law or the rights of any third party.
- 5.2 This indemnification and hold-harmless obligation survives termination of this Agreement and your cessation of use of the Services.
6 · Limitation of liability — maximum $1.00 CAD
- 6.1 TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE RELEASED PARTIES FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THIS AGREEMENT SHALL NOT EXCEED ONE CANADIAN DOLLAR ($1.00 CAD).
- 6.2 IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- 6.3 Some jurisdictions do not allow certain limitations; where a limitation is unenforceable, liability shall be limited to the greatest extent permitted by law, and in no event beyond the $1.00 CAD cap where enforceable.
7 · Assumption of risk
- 7.1 You voluntarily assume all risks associated with using the Services for research purposes, including the risk that outputs may be inaccurate, incomplete, or outdated, and the risk inherent in acting without professional legal advice.
8 · Governing law and jurisdiction
- 8.1 This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
- 8.2 You irrevocably attorn to the exclusive jurisdiction of the courts of the Province of Ontario, and waive any objection to venue or inconvenient forum.
9 · Severability
- 9.1 If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be reformed to the minimum extent necessary to make it enforceable while preserving the parties' intent — including the $1.00 CAD liability cap in section 6.
10 · Entire agreement; amendments
- 10.1 This Agreement constitutes the entire agreement between you and the operator regarding the Services. The operator may amend this Agreement at any time by posting a revised version; continued use after posting constitutes acceptance.
11 · Termination
- 11.1 The operator may suspend or terminate your access to the Services at any time, with or without cause. Sections 4, 5, 6, 7, and 8 survive termination.
12 · Contact

By using the Services, you confirm that you are of the age of majority in Ontario (18 years or older), or are using the Services with the consent of a parent or guardian who accepts this Agreement on your behalf, and that you accept all terms above.
